Judge rules in favor of the City of Central in public records lawsuit
March 29, 2017
The plaintiff submitted numerous public records requests that included a wide variety of search terms and criteria. Of the responsive documents, very few were withheld by the City of Central, and those that were withheld were privileged documents. The plaintiff filed a motion, seeking to have the court compel the City to produce a listing in the form of a ‘Privilege Log' of the documents that the City withheld. The Plaintiff failed to identify any statutory authority for that request. The City of Central opposed the motion because it is not required by law to identify or provide privileged documents. The judge agreed with the City and denied the relief requested by the plaintiff.
